Terms and Conditions of Comando Geek!
- Comando Geek! is a technology company that offers services mainly related to e-commerce and digital payments. Its services are available on the websites www.comandogeek.com.br, as well as on its mobile applications, forming the Comando Geek! Ecosystem.
- These Terms and Conditions, along with the annexes explaining the services of the Comando Geek! Ecosystem (hereinafter referred to as “Terms and Conditions”), govern the relationship between Comando Geek! and the individuals using its services (hereinafter referred to as “Users”).
- By registering on the Site and using the Comando Geek! Ecosystem, the User automatically accepts and agrees to these Terms and Conditions. It is essential to read and fully understand all the clauses before using the services.
- Capacity to Use the Services:
a) Individuals of legal age with legal capacity to contract may use the services of Comando Geek!. Minors aged 13 or above may only use the account with the authorization of their legal representative, who will be responsible for the actions and obligations arising from the use of the account by the minor.
b) Individuals using the Comando Geek! Ecosystem on behalf of a company must have the capacity to contract on its behalf, and to use the account, the User must be active. - Registration and Account:
a) To use the services of Comando Geek!, the User must fill out the registration form with the requested data. The User agrees to provide accurate, precise, and truthful information and to keep their data always up to date. The User is responsible for the accuracy of the registration data.
b) Comando Geek! may request additional information to verify the identity of the User.
c) The account is personal, unique, and non-transferable. The User must keep their security password strictly confidential. The User may also create Collaborator Accounts and define access permissions, but remains solely responsible for the operations performed on their account.
d) If the User identifies unauthorized use of their account, they must immediately notify Comando Geek!. - Privacy of Data:
a) Comando Geek! ensures the privacy of Users’ information and protects their personal data. Information is treated responsibly and in accordance with the Privacy Statement of Comando Geek!, which can be accessed at [insert link].
b) Comando Geek! may contact users via chat, email, WhatsApp, or phone call to inquire about their experience on the platform and offer consultancy. - Use of Intellectual Property:
a) Comando Geek! and/or its related companies hold all intellectual property rights to its websites, content, services, products, trademarks, trade names, logos, designs, images, advertising slogans, copyrights, domains, computer programs, codes, developments, software, databases, information, technology, patents, utility models, industrial designs, trade secrets, among others (hereinafter referred to as “Intellectual Property”), protected by national and international laws.
b) The use of Comando Geek! products and services does not imply authorization to use its Intellectual Property, except with the prior and express consent of Comando Geek! and/or its related companies. User sellers using these products and services may not use Comando Geek! Intellectual Property in a way that causes confusion among the public and must conduct their commercial activities under their own distinctive brand or trade name, which is not confusable with the “Comando Geek!” brand and its family of brands “Comando.”
c) It is prohibited to use Comando Geek! products or services for illegal purposes, perform reverse engineering or create derivative works, use search or data extraction tools from the platform for reuse and/or create databases that include, in whole or in part, Comando Geek! content without express authorization.
d) Misuse, unauthorized use, or use contrary to current regulations that cause confusion or imply defamatory use, and cause harm, damage, or losses to Comando Geek! and/or its related companies are also prohibited.
e) If a User or any ad infringes Comando Geek! or third-party Intellectual Property, Comando Geek! may fully or partially remove the ad, apply sanctions as provided in these Terms and Conditions, and take corresponding extrajudicial and/or judicial actions. - Fees:
a) Comando Geek! may charge fees for its services, and the User agrees to pay them in a timely manner.
b) Fees may be modified or eliminated at any time, with prior notice provided in clause 2 of these Terms and Conditions. Temporary modifications to fees for the benefit of Users may also be made.
c) The User authorizes Comando Geek! to retain and/or debit existing and/or future funds from their Comando Pagamento account and/or registered bank accounts to settle unpaid fees or any other debts they may have.
d) To learn the detailed fees of each service, Users must consult the corresponding terms and conditions.
e) In all cases, the invoice will be issued according to the fiscal data that the person has uploaded to their account. - Responsibility:
a) Comando Geek! shall be liable for any defect in the provision of its service, to the extent that it is attributable to them and within the scope provided by the current laws. - Sanctions:
a) In case of violation of laws or these Terms and Conditions, Comando Geek! may notify, suspend, restrict, or permanently deactivate the User’s account, without prejudice to other sanctions established in the particular rules of use of Comando Geek! services. - Indemnity:
a) The User agrees to hold Comando Geek! and its related companies harmless from any liability to other Users, third parties, or entities, concerning their activities in the Comando Geek! Ecosystem.
b) Comando Geek! may make compensations, withholdings, or other necessary measures for the repair of losses, damages, and losses of any nature. - Annexes:
a) In addition to these Terms and Conditions, each service of the Comando Geek! Ecosystem has its own usage rules established in the corresponding annexes, which must be read and fully understood by the User. - Jurisdiction and Applicable Law:
a) These Terms and Conditions are governed by current legislation. Any controversy arising from their application, interpretation, execution, or validity shall be submitted to the Jurisdiction of the São Paulo-SP Court, except for claims filed by Users who fall under the legal concept of consumers, who may submit such claims to the forum of their domicile, as provided for in the Consumer Protection Code.
